A MAN was caught drug driving twice in two days, a court heard.

Shaun Kenneth Evans, 25, claimed that after the first occasion he was told by a police officer he would be fine to drive the next day.

Evans, of The Claytons, Bridstow, Ross-on-Wye, pleaded guilty to drug driving at Hereford Magistrates Court on Thursday.

Amy Davies, prosecuting said that at 1.10am on January 21, Evans was stopped by police while driving a silver Peugeot 206.

He was drug tested and was positive for being over the limit for Benzoylecgonine, the metabolite of cocaine.

Evans gave a reading of 300 microgrammes per litre of blood, the legal limit is 50.

Emily Gourley, mitigating, said that Evans has been banned from driving for 14 months following the drug driving incident a day before this offence.

"He was stopped by a police officer on the first occasion and was found to be over the limit," said Mrs Gourley.

"Evans was then told that if he left it a day then he would be fine to drive.

"He did drive the next day and the drugs were still in his system. He hadn't taken any additional drugs but knows this is no form of defence.

"The defendant didn't take the name of the police officer but the advice was wrong.

"This is not a defence but an explanation."

Magistrates ordered Evans to pay a £120 fine, £135 costs and a £30 victim surcharge.

He was also disqualified from driving for 14 months from that day.
