A SWERVING drink-driver was avoiding potholes when he was spotted by police, a court has heard.

Cesar Ferreira De Sousa admitted one count of drink-driving when he appeared before magistrates in Hereford.

Police had spotted his Renault Megane swerving in the road in Burcott Road in Hereford at 2.15am on July 17, prosecutor Mark Hambling said.

Ferreira De Sousa was pulled over and admitted he had been drinking, and was arrested after failing a roadside breath test. An evidential test in custody revealed he had 46 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35.

The court heard he has no previous convictions.

Chris Read, for Ferreria De Sousa, said the 39-year-old had been heading home in the early hours of the morning after finishing work at 10pm.

"He had gone to a friend's house where he drank some alcohol and had some food before getting in his car and going home," Mr Read said.

"One man's swerving is another man's avoiding potholes, but he came to the attention of police. He feels he will be able to continue in his job with the help of friends."

Ferreira De Sousa, of Kingsway, Hereford, was fined £240 and disqualified from driving for 13 months. He must also pay costs of £135 and a £96 victim surcharge.
