TWO Herefordshire businessmen whose company went bust earlier this year have been fined for tax offences.

Yon Daniel Saunders and Simon Mark Jenkins are directors of Point to Point Ambulance Service, which is currently in liquidation.

They both pleaded guilty to two counts each of failing to comply with Pay As You Earn (PAYE) regulations to give security or further security for payment of any amount.

HMRC requires employers and company directors to give an amount of security if there’s a risk they will not pay PAYE. This can be if employers have previously failed to comply with obligations or if HMRC has reason to believe they may fail to comply.

Giving security involves making a payment or a guarantee in the form of an authorised and improved performance bond that covers the amount of PAYE due over a four-month period plus any current arrears.

When employers or company directors do not pay, HMRC can prosecute in a criminal court.

Saunders, 45, of Oaker View, Leominster, and Jenkins, 38, of Newlands Road, Leominster were each fined £320 with costs of £85 and a victim surcharge of £320 by Hereford magistrates when they appeared in court on July 30.

The offences dated to November 20 last year, under two months before their company Point to Point collapsed into liquidation.

Court documents do not specify that the tax offences relate specifically to Point to Point.

Point to Point’s collapse prompted several employees coming forward about unpaid wages, with some saying they were owed thousands.

Jenkins responded at the time saying that the process to pay wages owed was underway.
