AN ILLEGAL scrap metal carrier has been handed a criminal behaviour order banning her from intimidating waste workers.

Valerie Jane Butler appeared before magistrates in Hereford in March after pleading guilty to two charges of handling, controlling, or transferring controlled waste without taking reasonable measures, and one count of transporting controlled waste with a view to make profit as an unregistered carrier.

The court heard from the prosecutor that Butler had failed to take all reasonable measures to ensure that scrap metal was transported by an authorised person, and failed to transfer that waste correctly according to regulations in Bromyard between May 17, 2020, and May 17, 2022.

She had also transported controlled waste, namely scrap metal, at various locations in Herefordshire for profit without being a registered carrier between the same dates, the court heard.

Butler, of Openfields, Bringsty, was fined a total of £360 and ordered to pay costs of £750.56 and a £36 victim surcharge.

She was also handed a three-year criminal behaviour order banning her from carrying or travelling with any controlled waste not produced by her, engaging in any waste management or clearance services in the course of a trade or business, or advertising or promoting any services relating to the carrying, disposal, or management of waste.

The 51-year-old is further banned from directly or indirectly causing threats of violence, engaging in any burning of waste, directly or indirectly causing intimidation to anyone employed or engaged by Severn Waste Services, and directly or indirectly causing damage to any premises or waste belonging to Severn Waste Services.
