Herefordshire Council is dogged by legal problems after Widemarsh Street revamp

THE £1.3 million re-vamp of Hereford’s Widemarsh Street might cost more that Herefordshire Council had expected.

Councillor Adrian Blackshaw, cabinet member for economic development, confirmed to a meeting of the council last Friday, July 16, that legal claims for falls in the new-look Widemarsh Street had started to come the council’s way.

Last month the Hereford Times revealed a number of shoppers needed hospital treatment for injuries including broken limbs after slipping or falling on the street’s new rippled surface.

And Coun Blackshaw’s comments came one day after another woman fell in Widemarsh Street. Jo Ferguson, from Robin Elt Shoe Shop, said staff helped the tourist who cracked her head after falling close to their shop.

The council conceded to “teething troubles” over the surface and put black tape down as a temporary measure to mark the difference between the road surface and the kerbside.

Most complaints about the new surface suggested that it was hard to distinguish between the kerbside and the same coloured strip in the road - to the extent that the two looked level.

Council heard that a full review of the Widemarsh Street scheme was due out by the end of this month.

Members were worried that claims could see the cost of the scheme rise.

The Council should not have proceeded with this scheme, once they realised there was a problem, instead they said "people will just have to get used to it" Now the claims are beginning to arrive.
The Council Tax payer will eventually be faced with the extra tax to pay the claims as usual.

Yes.
I've not even passed through Widemarsh St for the last two months, but I intend to visit there this weekend. And fall over. It seems our Council wants people like me to take them to the cleaners.

This country is a joke, what happens in places like India where uneven pavements are common place ? ... They dont go trying to get money out of the council because it simply wouldn't be given to them.

Maybe the people of Hereford should start looking where they are going rather than try and blame the council for there inability to walk.

I also hope the people who think that anyone who cant see the difference between the pavement and the road didnt drive into Hereford because quite clearly they are visually impaired and thus not safe to drive !!

@Ambrey What a cracking idea, lets deprive the schools and NHS of more public money so you can line your pockets.

@M M - Maybe people should look where they are going. I have managed to 'navigate' said area of the town with out falling flat on my face!!

How fortunate phxweb that you did not fall, obviously Lorna (pictured) was not so lucky, are you implying that she and the other people who have had the misfortune to fall were not looking where they were going?
I would have thought Hereford Council would have taken advise re pavement surfaces with the College for the Blind being sited within the city

My sympathies are with all who were injured and I wish them all a speedy recovery. However, I am physically disabled and I fall over most times I go out of the house either from loss of balance or uneven surfaces, but I certainly wouldnt consider taking legal action if I tripped over in this road. Lots of people fall over every day and this is never known to any one...any of the people injured could have fallen at any other location at any other time and probably wouldnt have been compensated

M M .... If they had been looking where they were going the would have seen the step in the pavement. End of story no debate needed
