Hereford man banned from tending grass

A MAN banned from tending to grass outside his Hereford home has vowed to carry on.

Brian Hubbard has been mowing, weeding and edging the grass verge outside his house in Dorchester Way, Belmont, for the past four years.

Now Herefordshire Council has ordered him to stop as he is “encroaching” on council land.

A letter from the council’s parks, countryside and leisure development service, dated September 8, was recieved by Brian on October 9 and gave him “28 days to return the area to its original state.”

It ordered “the removal of garden tools and furnishings, path/bed covering material,” and “all vegetation not in keeping with the surrounding area.”

Brian was also accused of “blocking up gate way access” and the “undertaking of maintenance.”

The letter warned: “If there is still an encroachment issue with the property further action will be taken which may result in the above works being carried out at your expense.”

Brian said a number of officers from the department visited his home while he was serving on Belmont Rural Parish Council as a tree warden, and all were aware of him looking after the verge.

“I like the place to be tidy and attractive - and I know the council’s contractors cannot do it all,” he said.

“I take pride in the area and rake leaves in the autumn. Do they want me to put dandelions and daisies in?

“The other day there were people smashing glass over the road. I got a broom, went over and swept it up, is that encroachment?

“I’m going to ignore the letter. They won’t quench my actvities.”

Belmont Councillor Heather Davies said Mr Hubbard and his wife should be congratulated for taking pride in the area.

“When I was on my way to see them, the road looked a mess because the grass had been cut but the cuttings left. Mr Hubbard should be thanked for picking his cuttings up,” she said.

“If more people were like that the area would look really nice. We should be supporting him because its brilliant what he does - not sending him letters like this.”

In a statement, Herefordshire Council said: “We are aware of Mr Hubbard’s endeavours to tend the land next to his home in Dorchester Way and commend him for his public spiritedness."

"We apologise if he feels the letter he received from us is heavy-handed. We are happy to meet Mr Hubbard to discuss the issue."

The 1,400 public spaces in the county are maintained by the council’s contractors who are paid out of the public purse.

I think the County grass cutting is carried out by Amey who provide a woefully inadequate service. I can point you to several open spaces where the grass is left to get so long that when they eventually turn up they have no chance of making it look remotely tidy. They just leave huge slumps of cuttings that could actually be baled up for cow feed! And of course we have recently had reports about the neglect of Belmont roundabout. They do have some 'pet' area's where they tend the grass on a regular basis. Like Cathedral Close. But unless the spaces are on their 'favourites' list you might as well forget it.

Clearly somebody somewhere dropped a clanger at Amey. Aren't the letters vetted before they go out? At least the council apologised quickly.

This is over the top do we want people too take pride in their surroundings or not. We all have a right to keep our neibourhoods tidy and if keeping a small grass area tidy is deemed wrong then we are heading in the wrong direction.

in reply to sue jones comments this is not a clanger dropped by hereford council, it is the normal for them, the same thing happened here to us and our neighbours so that now we have a complete eyesore outside our property instead of a nicely kept verge. The lane and the verges are never cared for in any way sice we all gave in to the bullyboy tactics of an uncaring council.

I think everyone agrees that someone in the council or in Amey made a big mistake in sending out a high handed letter that makes ordinary people feel like criminals. Not only that, it looks as if the letter was produced and dated, then sat on that person's desk for a few weeks before they sent it out. I think it is a good thing that the council apologised so quickly, however. You hear of so many letters from utilities where an astronomical final demand is sent to a pensioner and a computer error is blamed. Sadly, it is quite normal for councils and companies to make this sort of mistake and it is usually due to some individual who doesn't have an ounce of common sense. Hopefully, systems will be put in place to make sure that only people with a brain are allowed to write letters to the public.

This has just been on Central News. The Council trotted out a bloke called Rob Hemblade to make some comments. He had a very impressive name badge hanging round his neck. He was laughing and smiling and just ended up looking a complete idiot!

I saw Central News but must have missed it. I am sure he did look like an idiot if he was the person who sent out the letter. Still I think it is interesting that people are more inclined to line up to criticise the man from the council than the man who drank over three times the legal limit then drove his car and killed someone.

There's not very much scope for debate with the drink drive death. Everyone agrees the driver was wrong. Not everyone will agree with the length of the sentence but what he got is pretty much par for the course for that type of offence.

That's a good point Joe Soap. I have to admit that I do know a few people who work for the council or have friends who know someone. One I know worked round the clock during recent floodings to clear blocked roads, another works with adults with learning difficulties and another faces heart-breaking issues as a social worker, and I know lots of teachers. They I know are dismayed by the attitude of the person who wrote the letter to Mr Hubbard. But because they work for the council, it doesn't matter if they really do care about the service they give to the community, they are still vilified because of the actions of one person. When one drunk driver kills someone, we don't all comdemn everyone who drives a car.

I also think the council really needs to take action as a result of the mistake. The immediate apology was good but it needs to do more in addressing its own internal systems to make sure members of the public are always treated with respect.

I think there is another aspect of this story that hasn't been considered. If an individual maintains a strip of public land for a period of ten years, they can lay claim to that land. So if I was to mow a strip of public land adjacent to my own property I could be entitled to extend my garden. Local authorities have to remind people from time to time that the land belongs to the public and this reminder is then registered, and automatically means the person maintaining the land has to start their 'ten years' all over again. These letters are not popular for that very reason. I am not saying that was the intention of ex-councillor Hubbard (who would know the law in this respect). I am also not saying that the council could not have handled better their requirement to send the letter.

According to my neighbour, Moor Spin, this sounds rather like, "We apologise if anyone could interpret the letter he received from us as being negative. We only wished to thank him for his efforts."

Perhaps Mr. Hubbard should be required to sign a 5 year lease for the area. The council could then drag him into court every week for not maintaining the area within their strict standards of standardisation!

Alternatively, this could be the groundwork for a more forceful "Litter Act"!

"Any third party removing litter deposited in a public place shall be responsible for a fine of not less than ten times the fine imposed upon the first party who originaly deposited the afore mentioned litter", said Mr. Henry Crun and Minnie Bannister in unison.

Such an offence of removing criminal evidence without a court's permission must constitute an offence of the gravest nature.
