A SIGNALMAN in charge of a level crossing where a woman died appeared in court this afternoon.

Adrian Maund, aged 41, and representatives from Network Rail both declined to enter a plea to the health and safety charges at Birmingham Magistrates Court.

The Crown Prosecution Service (CPS) issued summonses against Maund and Network Rail in August last year in relation to the death of Jane Harding.

Jane, 52 and from Marden, was a passenger in a car that was hit by a train at Moreton-on-Lugg in January, 2010.

Jayne Salt, head of the West Midlands CPS complex casework unit, advised the British Transport Police that Maund should be summonsed under section seven of the Health and Safety Act for failing to take reasonable care for the health and safety of other people likely to be affected by his actions or omissions at work.

She added that Network Rail should also be prosecuted under section three of the Health and Safety Act which imposes a duty on an employer to conduct their undertaking in such a way to ensure, as far as is reasonably practicable, that persons not in their employment are not exposed to risks to their health and safety.

The matter has now been referred to Birmingham Crown Court where Maund and Network Rail representatives will appear in April.
