Ross licence reviewed after complaint

A ROSS-on-Wye pub has had its licence reviewed after a member of the public complained about nuisance noise and smoking outside the premises.

Extra conditions have been imposed on the Horse and Jockey pub in New Street at the request of a local resident.

The current licence allows for the performance of live music, recorded music, dancing and sale of alcohol between 11am and 11pm (Monday to Wednesday), 11am to midnight (Thursday to Saturday) and noon to 10.30pm on Sunday.

One of the extra conditions is that a notice must be displayed at the entrance to the pub stating: “Customers must not smoke on the street outside these premises. Any person failing to observe this condition will be refused further service at the bar upon re-entry.”

Herefordshire Council’s sub-committee also said that no televisions or amplified music could be used on any external area of the pub after 9pm.

It's not clear from the article if the ban on smoking outside the doors is due to smokers chatting outside or the neighbours/Councils grudge against smoking itself!
The Councl have no legal authority to ban people on the street from smoking (the Law is quite specific about enclosed public areas) and it wouldn't be the first time figures don't understand the law (NHS managers are also attempting a similar illegal extension of the ban - ignored by both staff and patients as authoritarian nonesense).
This muscic venue will suffer (akin to economic torture) from these over stretched authority. And why should one trivial neighbour be given priority over dozens of music lovers wanting a ciggy outside (ie. already pushed about)?
This neighbour purchased a property by a music venue. If he's a complaint to make it's the smoking Law has caused socialising to spill out on the street. Complaints to the Labour Party are not responded to as these guys just don't listen to anybody!
