Landlord first in county facing action on smoking ban

Rebel landlord Tony Blows is the first person to be prosecuted in the county over the country's anti-smoking laws.

Tony, who runs The Dog at Ewyas Harold, will plead not guilty.

The case has been brought by Herefordshire Council after undercover visits by officers to the pub.

He faces charges of twice failing to stop customers smoking and of smoking there himself.

From what I remember from an earlier report Mr. Blows is saying that it's a health and safety issue and his staff might get assaulted if they ask a smoker to extinguish his or herself! Does he take the same approach re drunken or rowdy behaviour in the pub? ie tell his staff not to interfere on health and safety grounds? Anyway- about the smoking issue. It will provide some amusement seeing these two parties having a go at each other over the coming weeks/months! ha ha! One other thing...what other pubs are getting done? I've seen smokers illegally smoking in the enclosed doorways of loads of pubs in Hereford.

What a waste of tax payers money defending some stupid law that complete denies us our civil rights. Can't even have a fag whilst driving now. Anyone else think that'll lead to an increase in road rage? I mean, come on, we're living in a nanny state. Everyone in my household smokes, and we have non smoking friends who come round and don't care. Apparently you're not allowed to smoke in our local bus station, which is adjacent to a shopping mall, but I've seen the actual bus drivers smoking by their vehicles, and nothing has been done. So why are they bending the rules for some and not for others? Why does this one man get taken to court for allowing the consumption of legal products on private property? When's the tax payer gonna stop paying for the Government's over compensating nanny state paranoia?

When will the Government realise that they have been conned by the WHO, ASH and the rest of the Anti-Smoking lobby and have passed a law that is a travesty of justice.When the Council loses this case it will be taxpayers money that will be used to cover costs. How much money has the NHS wasted on Anti-Smoking programmes when it should have been put to use fighting the c.difficile debacle that has just come to light. Lets see THEM in court, not Tony.

I tend to agree that the person in control of any given property should set the 'House Rules' and if people want to visit then they can abide by the rules. I'm just a little bit worried that if this goes the wrong way, at the end of the day, then Tony Blows will be wiped out financially.

Why should tax payers money be used to defend this stupid ban in court? It should be up to the landlords to decide whether or not to allow smoking on THEIR premises. Good luck Tony, you have a lot of support!

This whole farce is an attempt to intimidate Mr. Blows. I sincerely hope that it blows up in their faces (pardon the pun). It is time that these self appointed bigots got what is coming to them. The majority of the English public most certainly support Mr. Blows.
