A SON who sent a message to his mum to wish her a Happy Mother's Day has been fined for breaking a restraining order.
Thomas Probert, 28, of Widemarsh Street, Hereford pleaded guilty to sending a message via Facebook between March 3 and March 22 to Michelle Graham, which he was prohibited from doing due to a restraining order which runs until October 2018.
He accepted he had broken a conditional discharge which he had been given on October 7 last year for 12 months for an offence of malicious communication.
Adrian Jones, prosecuting, said the breach took place on March 21 at 3pm when he sent a Facebook message to his mum, Mrs Graham, saying, "Happy Mother's Day. Miss you lots."
Emily Gourley, mitigating, said it is a sad case. She said Mr Probert made allegations against his step-father, which resulted in him being estranged from his mum. She said he harassed both his step-father and mother, which led to the restraining order being put in place.
She added: "He hasn't been threatening or abusive. I asked him, why did he sent it. He misses his mother. He has never had anything against her."
Probert was given a £110 fine and re-sentenced for breaking the conditional discharge with a £50 fine. He was ordered to pay £100 prosecution costs and a victim surcharge of £30.
