A DOMESTIC argument resulted in a man appearing in court after damaging a fence panel and window.

Samuel Hossack, 25, of no fixed abode, pleaded guilty to criminal damage at Hereford Magistrates Court on Thursday.

Adrian Jones, prosecuting, said that the incident happened on April 18, following a domestic argument with his partner who was a tennant at a property in Elm Grove, Clehonger.

Mr Jones said: "She tells him to leave and Hossack storms out, jumps over a fence and goes to the front of the property demanding his belongings back.

"She refuses to open the door so he kicked a fence and then punches a glass window by the door causing it to smash.

"The property was owned by Herefordshire Housing."

Hossack said that it wasn't his intention to damage the property but he was venting his frustration.

On interview he said his actions were 'reckless' rather than malicious and that his partner should have let him have his belongings.

Afterwards he realised he needed to leave and removed himself from the situation.

"He was very tearful on interview and said he no longer wanted a relationship with his former partner and wanted to move on with his life," added Mr Jones.

Rob Macrory, mitigating, said that the incident was a 'storm in a tea cup'.

"These two had been in a relationship and both have mental health issues, said Mr Macrory.

"Between the two of them they agree that they can't live together but remain friends. He left the property and in the heat of the moment realised he hadn't got his clothes and didn't intend to break the window. He ran away from the property by jumping over a fence and that now wobbles and didn't before."

Magistrates gave Hossack a conditional discharge.

He was also ordered to pay £135 costs, a £20 victim surcharge and £160 compensation to Herefordshire Housing.
