A MAN who was caught drink driving for the third time was also found to have cannabis in his system.

Kieren Duff of The Yetts, Sedbury, Chepstow pleaded guilty to both drug and drink driving and for possessing cannabis.

Herefordshire Magistrates Court heard the 30-year-old was stopped by police on Eign Street on December 4 at 11.30pm because he had a defective exhaust and brake light.

Officers could smell cannabis and his breath smelt of alcohol.

He was breathalysed and had 59mg of alcohol per 100ml of breath- the legal limit is 35mg. A blood test was taken and had had 3.2mg of the constituent of cannabis in his system- the legal limit is 2mg. He was also found to have £2.50 worth of cannabis on his person.

He had two previous convictions of drink driving- both within the last ten years- one in 2009 and one in 2012.

Chris Read, defending, said Duff is at a loss to explain why the reading of alcohol was so high as it did not match up to what he had drunk. He had smoked the cannabis a couple of days before, he said, and did not realise it would be in his system.

Magistrates disqualified Duff from driving for 40 months, for both the drug and drink drive charges which will run concurrently. He was fined £370 for each charge and for the possession of cannabis he was fined £50. He was ordered to pay £185 court costs and a £37 surcharge.
