A 42-YEAR-old who was caught drink driving for the third time has been banned from driving for 40 months.

Spencer Davies of Heol Cae Tynewydd in Loughor, Swansea was stopped in Belmont Road in Hereford on January 20 at 8.40am by police because he was not wearing a seatbelt. Officers smelt alcohol and he was breathalysed and had 57mg of alcohol in 100ml of breath- the legal limit is 35mg.

He pleaded guilty to drink driving at Herefordshire Magistrates Court.

The court heard he had been working on a stressful job the day before as a gas engineer and had drank six cans of Stella when he got home. In the morning he got up and had felt fine to drive.

He had been convicted for drink driving twice before- in 1997 and 2011.

He was disqualified from driving for 40 months, which can be reduced by 10 months if he takes a drink drive rehabilitation course. He was given a community order for 12 months, which included 100 hours unpaid work. He was ordered to pay court costs of £135 and a surcharge of £85.
